🎯 Learning Objective
Distinguish direct vs indirect taxes, understand GST and Article 279A, and know the key Budget and Finance Commission articles.
💡 Concept
- Direct tax = paid directly by the person on whom it is levied; the burden cannot be shifted (e.g. income tax, corporate tax) — administered by CBDT
- Indirect tax = levied on goods & services and passed on to the consumer (e.g. GST, customs duty) — administered by CBIC
- GST (Goods and Services Tax) was launched on 1 July 2017 — 'One Nation, One Tax'
- GST was introduced by the 101st Constitutional Amendment Act, 2016
- Article 279A provides for the GST Council, chaired by the Union Finance Minister; GST slabs are 0%, 5%, 12%, 18% and 28%
- Article 112 requires the 'Annual Financial Statement' — the official name of the Union Budget
- Article 110 defines a Money Bill; Article 266 covers the Consolidated Fund of India
- Article 280 provides for the Finance Commission, set up by the President every 5 years to share taxes between Centre and States
- India's financial year runs 1 April to 31 March
- The first Union Budget of independent India was presented by R. K. Shanmukham Chetty (1947)
✏️ Easy Example
Q. Which of these is a DIRECT tax? (a) GST (b) Customs duty (c) Income tax (d) Excise duty
- Direct tax = burden stays on the same person, cannot be shifted
- Income tax is paid directly by the earner
Answer: (c) Income tax
🇮🇳 Real-Life Example
Look at any restaurant bill — the 'CGST 2.5% + SGST 2.5%' line is Article 279A in action. That single 5% slab, split between Centre and State, replaced a dozen older taxes overnight in July 2017.
📝 Exam-Level Example
Q. The GST Council is constituted under which Article of the Constitution?
- GST came via the 101st Amendment which inserted new articles
- Article 279A specifically provides for the GST Council
Answer: Article 279A
📝 Exam-Level Example
Q. In the Constitution, the Union Budget is referred to as the ______ under Article 112.
- The Budget is not named 'Budget' in the Constitution
- Article 112 calls it the 'Annual Financial Statement'
Answer: Annual Financial Statement
🪄 Memory Trick
Direct tax you pay 'direct' from your own pocket (income/corporate). GST = July 1, 2017 → remember '279A' as the Council (2+7+9 near the GST era). Budget = Article 112 ('1-1-2', simple ladder).
⚠️ Common Mistakes
- ❌ Calling GST a direct tax (it is indirect — on goods & services)
- ❌ Writing the GST date as 2016 — the Amendment was 2016 but GST launched 1 July 2017
- ❌ Confusing Article 280 (Finance Commission) with Article 279A (GST Council)
🏆 Exam Tips
- ✅ Direct = CBDT, Indirect = CBIC — match the board to the tax type
- ✅ Cluster the article numbers: 110 Money Bill, 112 Budget, 266 Consolidated Fund, 280 Finance Commission, 279A GST Council
📌 Summary
- Direct tax (income/corporate) can't be shifted; indirect tax (GST/customs) is passed to consumers
- GST: launched 1 July 2017, via 101st Amendment; Council under Article 279A
- Budget = Article 112 (Annual Financial Statement)
- Finance Commission = Article 280, every 5 years
